2. The petitioner is in custody in connection with Aurai P.S Case No. 165 of 2025 dated 24.07.2025 registered for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act.

3. As per allegation in the FIR, there is recovery of 250.56 litre of illicit liquor from the Bolero vehicle bearing Registration No. BR07PA5888.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that petitioner's name has been figured from the confessional statement of the co-accused namely Amar Nath Chaudhary. He further submits that petitioner is not the owner of the said vehicle and he has nothing to do with the alleged

Patna High Court CR. MISC. No.73235 of 2025(2) dt.15-10-2025 2/2 recovery of the illicit liquor. He further submits that there is no independent witness to the alleged occurrence. It is also submitted that petitioner is in judicial custody since 01.09.2025 having five antecedent of similar nature.

5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.

On perusal of the FIR and impugned order dated 20.09.2025, it appears that petitioner's name has been figured from the confessional statement of the apprehended co-accused person namely Amar Nath Chaudhary. Moreover, petitioner is not the owner of the said vehicle and he has nothing to do with the alleged recovery, so, considering the aforesaid facts and circumstances of the case and submissions made on behalf of the learned counsel for the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Exclusive Excise Judge-II Muzaffarpur in connection with Aurai P.S Case No. (Ramesh Chand Malviya, J) Sunnykr/- U
