The petitioner is apprehending his arrest in connection with Madanpur P.S.Case No.147 of 2018 registered for offences punishable under Sections 269, 347 and 406 of the Indian Penal Code and Section 16 of Clinical Establishment Control and Regulation Act.
Allegation against the petitioner is that the petitioner is running the Clinic without having licence issued by the Clinical Establishment and the hospital has no Oxygen Cylinder and operation of a patient was done there. The petitioner is said to have been running the clinic.
Submission of the learned counsel for the petitioner is that he is land owner and the hospital is of one Niraj Kumar, who
Patna High Court Cr.Misc. No.43519 of 2018 (2) dt.06-08-2018 2/2 brings the patient in the hospital and the petitioner has falsely been implicated in this case.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner surrender before the learned court below within a period of four weeks from the date of receipt of the order and make prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by the order of this Court, if possible on the same day.
