JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 24-03-2023 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 385,504,506,509/34 of the IPC and section 12 of the POCSO Act.
Prosecution case is that the petitioner and the informant's minor daughter were members of a Whatsapp group in which some type of obscene messages were typed and sent between the members of the group.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case only on the basis of suspicion. petitioner's mobile phone has never been used in transaction of obscene contents to the victim. There is no direct or indirect evidence against the petitioner. Petitioner has got no criminal antecedent. Considering the aforesaid facts of the case, prayer for
Patna High Court CR. MISC. No.408 of 2023(2) dt.24-03-2023 2/2 bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge VI cum Special Judge, POCSO Act Samastipur in Vidyapatinagar Police Station Case No. 69 of 2020, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
