The petitioner seeks bail in a case registered for the offence punishable under Section 414 of the Indian Penal Code. Prosecution case is that on 29.08.2019, the informant got a secret information that the petitioner has received the motorcycle bearing no. BR023-6157 knowing it to be stolen, the informant proceeded with police force and found that a person driving the motorcycle was going and he having seen the police, began to flee away. The informant caught the person with the help of police force and this person identified himself as Rajendra Dom and he did not present any document relating to the ownership of the motorcycle which is in his possession.

Learned counsel for the petitioner submits that petitioner is innocent, has committed no offence and has been falsely implicated in this case. He further submits that petitioner is in custody since 30.08.2019.

Learned counsel for the State submits that petitioner is named in the FIR and the said motorcycle is recovered from the possession of the petitioner which is stolen motorcycle. Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. Accordingly, his payer for bail is rejected in connection with Barhara (Sinha O.P.) P.S. Case No. 298 of 2019 pending before the court of the learned Chief Judicial Magistrate, Bhojpur at Ara. Accordingly, the application is dismissed. However, the petitioner is at liberty to renew his prayer for bail after six months.
