The petitioner seeks bail in connection with Special Case No. 08 of 2008/32 of 2011 vide R.C. No. 8(A) of 2008, registered for offence punishable under Sections 120(B), 420, 467, 468 and 471 of the Indian Penal Code and Section 13(2) read with Section 13(i) (d) of the Prevention of Corruption Act. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Further submission is that the petitioner undertakes to deposit the outstanding amount of Rs.

Patna High Court CR. MISC. No.68323 of 2019(3) dt.22-11-2019 2/2 10,000,00/- (Rupees Ten Lacs) approximately, in three equal installments in nine months. The petitioner is in custody since 25.09.2019.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties specially the undertaking given by the petitioner, let the above-named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Central Bureau of Investigation, South Bihar, Patna in connection with Special Case No. 08 of 2008/32 of 2011 vide R.C. No. 8(A) of 2008.

It is made clear that, the aforesaid payment made by the petitioner to the Bank will be subject to final outcome of the case.

In case, petitioner fails to keep his undertaking, it will be open for the Court below to take steps for cancellation of his bail bonds.
