====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 04-11-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is in custody in connection with Sherghati P.S. Case No. 47 of 2019, G.R. No. 152 of 2019 for the offenses under Sections 25(1-b)a, 36 and 35 of the Arms Act.
Learned counsel for the petitioner submits that though the petitioner is accused in 14 criminal cases, he has been acquitted in 10 of such cases. Allegation against the petitioner in the instant case is that from his possession one country made pistol with live cartridge was recovered. The petitioner is in custody since 11.02.2019.
Considering the period of custody, the Court is
Patna High Court CR. MISC. No.66677 of 2019(2) dt.04-11-2019 2/2 inclined to grant bail to the petitioner. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Sherghati, Gaya, in connection with Sherghati P.S.
