This is an appeal under Section 14(A)(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 against the refusal of prayer for anticipatory bail vide order dated 07.06.2018 passed by learned Special Judge S.C./S.T. Act-cumAdditional Sessions Judge-V, Patna in A.B.P. No. 3914 of 2018, arising out of Salimpur Police Station Case No.186 of 2017, registered under Sections 147, 148, 149, 341, 323, 307, 504 and 506 of the Indian Penal Code and Section and 3(i)w/3(i)(R) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.
The FIR prima facie discloses commission of offence
Patna High Court CR. APP (SJ) No.2264 of 2018 dt.04-10-2018 P2/ under the provisions of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. There is no material to substantiate malicious prosecution. Hence, in my view, there is no merit in this appeal against refusal of anticipatory bail.
Accordingly, the appeal stands dismissed as devoid of any merit.
