2. This is the 2nd attempt of the petitioner. Earlier the bail application of the petitioner was rejected vide order dated 09.04.2024 passed in Cr. Misc. No. 4854 of 2024.

3. The petitioner seeks regular bail in a case registered for the offence under Sections 25(1-b)a, 26, 28, 35 of the Indian Penal Code.

4. As per the prosecution case, there is recovery of huge quantity of arms and ammunition from co-accused namely Md. Anjarul and Md. Salman who have disclosed the name of the petitioner as the salesman of the arms.

5. Though the learned counsel for the petitioner has argued that similarly situated co-accused have been granted bail by this Court but considering the development in the case i.e.

Patna High Court CR. MISC. No.80005 of 2024(2) dt.18-12-2024 2/2 six charge-sheeted witnesses have been examined out of 7 charge-sheeted witnesses in the trial. This is not a fit case for grant of bail.

6. In view of the recent judgment of Hon'ble Supreme Court in the case of X vs. State of Rajasthan, 2024 SCC OnLine SC 3539, this application for regular bail is hereby rejected.
