JUSTICE SUDHIR SINGH ORAL ORDER 05-03-2020 Heard learned counsel for the petitioners and learned APP for the State. A supplementary affidavit has been filed on behalf of the petitioners which is kept on record. The petitioners seek bail in a case instituted for the offences under Sections 364/34 of the Indian Penal Code. The prosecution case in short is that the accused persons called the informant and forcibly abducted him. It has been submitted on behalf of the petitioners that the petitioners are in custody since 18.8.2019 and have got no criminal antecedent. Annexure-2 to the supplementary affidavit is the petition filed on behalf of the informant where he has retracted from the earlier statement made in the F.I.R. The petitioner has been made accused due to mistake of facts. The victim has already been recovered. On behalf of the State, it is submitted that the petitioners are named in the F.I.R..
Considering the aforesaid facts and circumstances, it is directed that the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Sherghati, Gaya in connection with Raushanganj (Bankey Bazar) P.S.
