The accused/petitioner is named in the F.I.R. and apprehend his arrest in connection with Teghra P.S. Case No. 200 of 2022 registered for the offences punishable under Sections 341, 323, 427, 379 and 307/34 of the Indian Penal Code.
The allegation against the petitioner is to assault informant and others along with other co-accused persons, by means of iron (hansuli), on neck and other part of body, causing injury, having intention to cause death, where, occurrence is alleged to be founded over land dispute.
Learned counsel appearing on behalf of the petitioner
Patna High Court CR. MISC. No.74893 of 2022(2) dt.03-05-2023 2/2 submitted that allegation as regard to assault is not available against this petitioner, rather same is specific against other coaccused persons, namely, Babita Devi and Ram Naresh Choudhary. It is also submitted that occurrence is founded over land dispute, where, petitioner is a man of clean antecedent. Learned APP for the State, opposes the prayer of bail. Considering the aforesaid facts and circumstances of the case, as allegation as regard to assault is not available against this petitioner, let above named petitioner, in the event of his arrest or surrender before learned court below within a period of four weeks, is directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai /concerned Court, where the case is pending in connection with Teghra P.S. Case No. 200 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
