The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 341, 323, 308, 379, 504, 506/34 of the Indian Penal Code. The prosecution case, in brief, is that when the informant was passing via Gandhhinagar, in the meantime, the petitioner along with co-accused persons intercepted him and snatched Rs. 4500/- from his packet on pistol point. It is further alleged that co-accused Chiku Pandit assaulted on head of informant by means of iron rod due to which he sustained injuries. Thereafter, the accused persons also snatched his motorcycle bearing Registration No. BR-02AJ-5188. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.700 of 2023(2) dt.27-03-2023 2/2 petitioner is innocent and has committed no offence. He has falsely been implicated in this case. As per FIR, main allegation of snatching is against co-accused Kalu Paswan and assaulting is against co-accused Chiku Pandit. There is no specific overtact against this petitioner. No any looted material was recovered from conscious possession of the petitioner. It is further submitted that the petitioner is languishing in judicial custody since 14.9.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Muffasil P.S. Case No. 214 of 2020 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Gaya.
