JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-02-2020 This application has been filed for cancellation of bail granted to O.P.no.2 vide order dated 18.9.2017 passed in Bhagalpur Mahila P.S.case No.38 of 2017 under Sections 498A, 494, 341, 323, 504, 506/34 of the IPC by learned Sessions Judge, Bhagalpur.
Grounds for cancellation of bail is that the petitioner is still ready to reside with the O.P.no.2 and another ground is of threatening and in support of that she has filed an informatory petition.
Heard learned APP as well as the learned counsel for the O.P.no.2 and perused the impugned order from which it appears that the learned Sessions Judge has tried for mediation
Patna High Court CR. MISC. No.30751 of 2018(4) dt.24-02-2020 2/2 but the petitioner was not ready to reside with the O.P.No.2 and considering the same the O.P.no.2 was granted anticipatory bail by the learned sessions Judge. So far submission that there is threatening to the petitioner is concerned and only an informatory petition has been filed, there is nothing available on the record to show that the same has been inquired into and found to be true.
Considering the above, I find no merit in this application. Accordingly, this application is dismissed. (Vinod Kumar Sinha, J) chn/- U T
