2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 309(4) of the Bharatiya Nyaya Sanhita.
3. Prosecution case, in brief, is that on 14.06.2025 at about 3 AM, two unknown persons boarded on e-rickshaw of the informant to go to the office of Dainik Jagran, Barari but upon reaching there, they asked to proceed to Jyoti Bihar Colony and when informant refused to go there, the accused persons snatched Rs. 700/- and key of his e-rickshaw and fled away.
4. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. and his name surfaced in this case during course of investigation in confessional
Patna High Court CR. MISC. No.73085 of 2025(2) dt.01-11-2025 2/2 statement of co-accused Doulat Kumar who disclosed that they sold the stolen e-rickshaw on payment of Rs. 23,000/- to this petitioner. No incriminating material has been recovered from conscious possession of the petitioner. Petitioner has got no criminal antecedent of similar nature.
5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate I, Bhagalpur in connection with Industrial Area P. S. Case No. 86 of 2025, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
