The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 341, 323, 380, 386, 420, 504 and 120(B) of the Indian Penal Code and section 4 of PMLA Act.

As per allegation in the FIR, firstly accused persons offered the complainant for money to increase his cloth business @ 3 rupees interest for every hundred rupees. The complainant has borrowed one lakh and returned the amount with interest. It is alleged that on 28.08.2019 the accused persons including the petitioner came at the shop of the informant and demanded Rs. 50,000/- and on refusal he was assaulted with feast and slap and was threatened that his shop will be closed. On 11.09.2019

Patna High Court CR. MISC. No.3624 of 2023(2) dt.03-04-2023 2/3 again petitioner along three un-known miscreants armed with knife and pistol assaulted to complainant and took away Rs. 60,000/- from cash box. Accused Manoj Yadav took two bundles of cloth worth Rs. 80,000/- .

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. The instant case has been lodged by the informant with an intention to grab money of the petitioner. The informant during business taken some loan from the petitioner and when the petitioner demanded the said money to return, informant to put pressure upon the petitioner, lodged this false case. There is no documentary proof regarding transaction of money on record. Chargesheet has been submitted against the petitioner u/s 341, 323, 385, 504/34 of the IPC. Petitioner has no criminal antecedent. He is languishing in judicial custody since 22.08.2022.

The application for bail is opposed by learned APP for the State and submitted that there is allegation of forgery of huge amount against the petitioner.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named

No.3624 of 2023(2) dt.03-04-2023 3/3 petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Madhubani in connection with Kaluahi P.S. Case No. 170 of 2019.
