Mr.Dashrath Mehta ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 11-12-2019 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks regular bail in connection with Motihari Town PS case no. 654 of 2018 instituted for the offence punishable under Sections 341, 504, 307/34 of Indian Penal Code.

The petitioner is stated to have approached this Court earlier for grant of regular bail and this Court, vide order dated 01.04.2019 passed in Cr. Misc. no. 16654 of 2019, had observed as follows:- " Having regard to the fact that during the course of altercation having taken place between the parties, the petitioner is said to have stabbed the informant by a knife and the said injury

Patna High Court CR. MISC. No.67049 of 2019(2) dt.11-12-2019 2/2 has been found to be grievous in nature, this Court is of the opinion that the petitioner is required to be in custody for some more time, hence, I deem it fit and proper to direct the petitioner to approach this Court after expiry of six months from today."

Having regard to the observations made by this Court earlier in its order dated 01.04.2019 and the petitioner having completed a period of six months of custody w.e.f. the date of the aforesaid order dated 01.04.2019 as also having completed more than a year in custody, I deem it fit and appropriate to release the abovenamed petitioner on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran in connection with Motihari Town PS case no. 654 of 2018.
