The petitioner is apprehending his arrest in connection with Sara P.S.Case no.31 of 2018 dated 26.3.2018 registered for offences punishable under Sections 420, 406, 409 and 120(B) of the Indian Penal Code.

Allegation against the petitioner who is rice miller is of supplying bad quality of rice of 9210.86 quintal and causing loss of Rs.3,85,00,000/-.

Submission of the learned counsel for the petitioner is that in this case rice miller along with PACS has been made accused in this case and in spite of that he is ready to give bank guarantee of Rs.01 crore if sufficient time is given to the petitioner. Heard learned A.P.P. and the learned counsel for the B.S.F.C. They have no objection of that.

No.38067 of 2018 (4) dt.30-07-2018 2/2 In such view of the matter, this application is disposed of with a direction to the petitioner to surrender within a period of 16 weeks along with bank guarantee of Rs.01 crore, which shall be deposited in the court below and if such bank guarantee is deposited, the petitioner shall be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Nalanda at Biharshariff in connection with Sare P.S.Case No.31 of 2018 dated 26.3.2018 subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure. In the meantime, no coercive steps shall be taken against the petitioner in connection with Sare P.S.Case no.21 of 2018 dated 26.3.2018.
