2. The petitioner seeks regular bail in connection with Minapur P.S. Case No. 583 of 2022 instituted for the offence punishable under Sections 25(1-b)A, 26 and 35 of the Arms Act.

3. It is a case of recovery of one country made pistol along with one mobile phone from the possession of co-accused Dilip Kumar.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He further submits that nothing has been recovered from the possession of the petitioner, petitioner is not apprehended at the spot and he is in judicial custody since 21.01.2023.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

Considering the facts and circumstances of the case and period of custody of the petitioner, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Muzaffarpur in connection with Minapur P.S.
