The petitioner is apprehending his arrest in connection with Danapur P.S.Cae nO.625 of 2017 registered for offences punishable under Section 135 of Electricity Act. Allegation against the petitioner is of committing theft of electricity energy to the tune of Rs.4,23,623/- and also there was electricity bill of Rs.7,230/- pending against him. Submission of the learned counsel for the petitioner is that if sufficient time is given to him he is ready to deposit the same. Heard learned A.P.P. and the learned counsel for the South Bihar Power Distribution Company Ltd..

Having heard both sides and in view of the facts and

Patna High Court Cr.Misc. No.40936 of 2018 (3) dt.30-07-2018 2/2 circumstances, this application is disposed of with direction to the petitioner to surrender within a period of six weeks from the date of receipt of the order along with a bank draft of Rs.88,000/- in favour of South Bihar Power Distribution Company Ltd. and on surrender along with the bank draft, he will be released on provisional bail for a period of seven months and rest of the amount shall be deposited in seven equal installments in seven months payable in the first weeks of each month and once the total amount is deposited within the period as stated above, the bail bond of the petitioner shall be confirmed and it is also made clear that in the case of failure to deposit any installment, his bail bond shall be cancelled.

The aforesaid amount so deposited shall be subject to result of the case.
