JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-12-2019 This is an application for grant of anticipatory bail in connection with Fatuha P. S. Case No. 411 of 2019 disclosing offences under Sections 302, 201, 120B of the Indian Penal Code and Section 27 of the Arms Act.

As per F.I.R. the dead body of the deceased was found and he suspects the hand of the petitioner, due to enmity from before.

Submission of the learned counsel for the petitioner is that the deceased was the accused in the murder case of his father, as such, he has been made accused in this case. It has also been submitted that some of the witnesses have stated that he has called the deceased from the house and taken her, which is not probable in the background of the previous enmity between the parties and except that there is no other allegation

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M.-V, Patna City, Patna, in connection with Fatuha P.
