The petitioner seeks bail in a case instituted for the offences under Sections 447, 341, 323, 324, 308/34 of the Indian Penal Code.

The prosecution case in short is that the accused persons assaulted the informant and other family members. It has been submitted on behalf of the petitioner that the petitioner is in custody since 2.9.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. Charge-sheet has been submitted in the present case. The nature of injury is said to be simple. The petitioner has remained in custody for about six months. As per allegation, no case of Section 308 IPC is made

Patna High Court CR. MISC. No.66821 of 2019(3) dt.04-03-2020 2/2 out. A single blow of barchi is said to have been given by the petitioner. There is no allegation of repitition. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Nautan (Jagdishpur) P.S.
