The petitioner seeks bail in a case registered for the offence punishable under Sections 363, 366(A) of the Indian Penal Code.

The prosecution case in short is that the informant has given application to S.H.O. Nautan stating therein that the informant along with husband went to out of station and her daughter Gayatri Kumari aged about 16 years was lonely in her house. It is further stated that meantime all accused persons came at her house and kidnapped her daughter on promise to give her mobile and money. It is further stated that when her husband came at his house, he found his daughter missing. It is further stated that on information, the informant along with her

Patna High Court CR. MISC. No.67571 of 2019(2) dt.04-11-2019 2/2 husband went to the house of accused persons and made query regarding her daughter. It is further stated that all accused persons started abusing and assaulting and gave threat to kill them.

Learned counsel for the petitioner submits that petitioner is innocent, committed no offence and has been falsely implicated due to village politics. He submits that the police has recovered the victim girl and she has given her statement under Section 164 Cr.P.C. where she clearly stated that she has not been kidnapped rather she had gone with her own will. Learned counsel for the petitioner further submits that medical examination shows her age to be 18-20 years. In the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bettiah, West Champaran in connection with Nautan Police Station Case No. 182 of 2019.
