The petitioners apprehend their arrest in a case registered for the offence under Sections 406, 410, 504, 506, 34 of the Indian Penal Code.
Allegation against petitioners is that informant had paid Rs. 3,25,000/- (three lacs twenty five thousand) to father of

No.74284 of 2022(2) dt.24-03-2023 2/3 petitioners Bishwanath Singh for purchasing a land appertaining to Khata No. 25 area 38 decimals of village Ramabandh and when the sale-deed was not executed in favour of informant, he demanded his money from the accused persons, which they did not return and thus, cheated the informant.
It is submitted on behalf of petitioners that from perusal of F.I.R., it is apparent that the agreement was entered into between the informant and other co-accused persons. Petitioners were neither involved in the matter nor any money was transferred into their account. Petitioners have been made accused in this case only because they happen to be son of coaccused Bishwanath Singh. Petitioners have got clean antecedent.
Learned A.P.P. for the State has opposed the bail petition.
Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Aurangabad (Town) P.S. Case No. 322 of 2022,
