2. Earlier, the prayer for bail of petitioner was rejected, vide order dated 21.03.2024 passed in Cr.Misc. No. 98 of 2024 (Annexure - P/1).

3. Trial Court report reveals that after framing of charge, despite issuance of summons, till date no prosecution witness has been examined.

4. It is submitted on behalf of petitioner that petitioner is in custody since 19.07.2023 and till date, not a single witness has been examined on behalf of prosecution. Petitioner has got clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail petition.

6. Considering the period of custody and tardy progress of trial, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge - II, Ara, Bhojpur in connection with Barhara (Krishnagarh) P.S. Case No. 438 of 2023.
