JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 09-01-2020 Following are the reliefs, which the petitioner is seeking in the present writ application :- (i) For issuance of direction to the respondents to provide proper information under right to information act to the petitioner about the result of Central Selection Board (Police Recruitment) Patna (Bihar) in advertisement no. 01/2018 in which

Patna High Court CWJC No.22533 of 2019(2) dt.09-01-2020 2/3 petitioner was appeared for the post of driver police and fireman service and marks what ever he was obtained out of total marks.

(ii) For direction to the respondents that on the basis of obtaining marks by the petitioner in the examination Test for Central Selection Board (Police Recruitment) Patna (Bihar) vide advertisement no. 01/2018 a fresh merit list may be published by the Board."

2. From the pleadings on record, it appears that the petitioner has preferred second appeal before the Chief Information Commissioner under the Right to Information Act with the allegation that the information sought has not been furnished.

3. Learned counsel appearing on behalf of Central Selection Board (Constable Recruitment) states that the petitioner has been furnished necessary information in March, 2019 itself. A copy of letter dated 06.03.2019 has been produced by learned counsel for the Board. From the said letter, it appears that the petitioner has been declared fail in Driving Efficiency Test (DET) and, therefore, he has been held ineligible for appointment as driver in Bihar Police.

4. The relief, which the petitioner is seeking, cannot be maintained in the present proceeding. In any view of the

Patna High Court CWJC No.22533 of 2019(2) dt.09-01-2020 3/3 matter, in view of the stand taken on behalf of the Board, the grievance of the petitioner does not survive any more. This application is accordingly dismissed.
