JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-11-2019 This application, for grant of anticipatory bail, arises out of Rajnagar P.S. Case No. 188 of 2017, disclosing offences under Sections 272 and 273/34 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act, 2016. Prosecution case is that there was recovery of liquor from co-accused, who during investigation disclosed the name of petitioner as the person, to whom, he used to make supply of liquor.

Submission of learned counsel for the petitioner is that he has no criminal antecedent and has falsely been implicated in this case only on the basis of confessional statement of co-accused except that there is nothing against the petitoner.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -II-cum-Special Judge (Excise Act), Madhubani, in connection with Rajnagar P.S. Case No. 188 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
