The petitioners have filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 341, 323, 324, 307, 504/34 of the Indian Penal Code.

The allegation against the petitioners is that they assaulted the informant due to which he sustained injuries. It is alleged that petitioner No. 1 assaulted the informant by means of lathi and Farsa.

It is submitted by learned counsel for the

Patna High Court CR. MISC. No.77111 of 2023(2) dt.04-12-2023 2/3 petitioners that the petitioners are innocent and they have committed no offence. They have falsely been implicated in the present case. There is inordinate delay of 6 days in lodging the F.I.R. Injuries sustained by the informant is simple in nature caused by hard and blunt substance. Moreover, the petitioners are languishing in judicial custody since 01.09.2023. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent.

Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail in connection with Bagen Gola P.S. Case No. 71 of 2023 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount
