JUSTICE BIRENDRA KUMAR ORAL ORDER 29-11-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420,406,409,467,468,471 of the Indian Penal Code.

Allegation is that the petitioner was agent of IDBI Bank. On persuasion of the petitioner, informant opened the bank account in the said bank. Money was deposited and after seven months, money was transferred to the account of Rajeev Kumar Singh, Proprietor of Narayan Tour and Travel Agency. Submission is that the case diary would reveal that the aforesaid defalcation of public money

Patna High Court Cr.Misc. No.56225 of 2018(3) dt.29-11-2018 2/2 took place in collusion between the informant and Rajeev Kumar Singh and not the petitioner. Moreover, co-accused-Dilip Kumar Pathak @ Dilip Pathak has already been allowed anticipatory bail by a Coordinate Bench of this Court in Cr.Misc. No.34670 of 2018. Let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000 (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Laheriasarai P.S.Case No.409 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
