The petitioner apprehends his arrest in connection with Town Hajipur P.S. Case No. 906/2018 registered for the offence punishable under Sections 353 of the Indian Penal Code read with Section 37(a) and 37(b) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that while he was in custody in connection with Hajipur Town P.S. Case No. 522 of 2018 and Town Hajipur P.S. Case No. 665 of 2018, in both the cases, he has already been extended the privilege of bail, the petitioner has been remanded in connection with the present case after his release and is thus apprehending his arrest. It is further submitted that the only allegation against the

Patna High Court CR. MISC. No.70665 of 2019(2) dt.27-11-2019 2/2 petitioner is of having consumed liquor and having misbehaved. It is further submitted that the entire allegations are false and mischievous and have only been generated to put the petitioner behind the bars.

Considering the aforementioned facts and circumstances and the nature of allegations, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-II-cum-Excise Judge, Hajipur, Vaishali, in connection with Hajipur Town P.S. Case No. 906/2018, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
