2. The petitioner has prayed for bail in connection with Nauhatta (Nauatta) P.S. Case No.144 of 2025 registered for the offence punishable under Sections 126(2), 115(2), 69, 352 of B.N.S.
3. The case of the prosecution, in short, is that the petitioner was in live in relationship with the informant from last 10 years and it is alleged that he has made sexual exploitation of the informant. Informant is pregnant also. It is further alleged that prior of this three abortions were done. It is also alleged that whenever the informant impresses the
Patna High Court CR. MISC. No.73243 of 2025(2) dt.09-12-2025 2/3 petitioner for marriage, the same is turn down on this or that pretext and the petitioner starts assaulting. It is further alleged that on 01.06.2025, the petitioner in influence of intoxication assaulted the informant.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. From perusal of the F.I.R., it is clear that the occurrence is of 01.06.2025 whereas the F.I.R. has been lodged on 08.06.2025. It has also been submitted that the informant is a married lady. As per the F.I.R. also the allegation is that the petitioner was in live in relationship with her from last 10 years. Informant is also having four children. Petitioner is having no criminal antecedent and he is languishing in judicial custody since 09.06.2025.
5. Learned APP appearing for the State has vehemently opposed the application for bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties
