This application for regular bail arises out of Mansoor Chak P.S. Case No. 102 of 2018, disclosing offence punishable under Sections 302, 120-B/ 34 of the Indian Penal Code. The wife of the deceased is the informant. According to the case of the prosecution, as disclosed in the FIR, the petitioner's husband had left the house in the evening of 21.11.2018, whereafter he did not return. In the night of 22.11.2018 she learned that a dead body was recovered by the police, which was identified to be that of her husband. In her fardbeyan, which is the basis for registration of the FIR, she has raised suspicion about involvement of the petitioner in commission of the offence because of previous dispute. It is

Patna High Court CR. MISC. No.75460 of 2019(4) dt.04-06-2020 2/2 evident on reading of the FIR that except for suspicion there is no basis for implication of the petitioner. On perusal of the case diary, it appears that there is no definite material to connect the petitioner with the offence alleged.

Considering the facts and circumstances, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned Additional Chief Judicial Magistrate-Ist, in Mansoor Chak P.S. Case No. 102 of 2018.
