The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 323, 504, 498A, 406, 314, 376 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.
Both the parties are physically present in Chambers. After reconciliation, the petitioner is ready to give Rs.7,000/- per month in the bank account of the wife-opposite party no. 2 bearing S.B.I. A/C No. 32920887996, Piro Branch for her maintenance. Thereafter, opposite party no. 2 shall withdraw the criminal case pending before the court below or take proper step for early disposal of the said case. If the
Patna High Court Cr.Misc. No.60815 of 2018(3) dt.03-12-2018 2/2 petitioner would fail to give maintenance that may give rise to criminal liability against the petitioner. After withdrawal of the criminal case, the parties shall be at liberty to restore their matrimonial life.
With the aforesaid observation, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending in connection with Sandesh Police Station Case No. 63 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
