JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-11-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 337, 353, 307 of the Indian Penal Code and section 27 of the Arms Act. Petitioner is named in the first information report with allegation that he as well as near about 200 persons made indiscriminate firing and pelted bricks upon the police party. However, learned counsel for the petitioner drew my attention towards Annexure-2 series and submits that none of the police personnel sustained fire arm injury. It is submitted that police after due investigation, submitted final form in favour of the petitioner showing him innocent but subsequently, the learned court below took cognizance against the petitioner.

No.67053 of 2019(2) dt.04-11-2019 2/2 He further submits that moreover, one co-accused namely, Sanjay Kumar@ Mani Lal@ Manilal Singh has already been granted privilege of anticipatory bail by a co-ordinate Bench of this Court vide order dated 03.09.2010 passed in Cr. Misc.23228 of 2010. Petitioner does not have any criminal antecedent and he is an old person aged about 85 years.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nawada in connection with Kawakole ( Rupau) P.S.
