JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-04-2024 The present writ petition has been filed seeking the following relief:- "1(I) For issuance of a writ in the nature of MANDAMUS giving directions to the Respondents to grant benefits of 2nd A.C.P and MACP along with its arrear of salary to the petitioner and further direct the authorities to fix the pension and other retiral benefits after grant of 2nd A.C.P. and MACP benefits and pay its arrears II. For issuance of writ or writs/order or orders/direction or directions in the nature of writ of Mandamus directing the respondents to treat the period w.e.f. 19.07.1966 to

Patna High Court CWJC No.16888 of 2023(2) dt.20-04-2024 2/3 31.01.2001 as regular service for all purposes as in the aforesaid period whereby petitioner worked Livestock Assistant in Respondent State. The Respondents have unreasonably and malafidely have not counted the aforesaid period as qualifying service for the purpose of counting ACP/MACP.

III. For issuance of a writ in the nature of mandamus directing the Respondents to treat his initial appointment w.e.f. 19.07.1966 as regular appointment with all consequential benefits including the benefits under the ACP Scheme and fix the pension of the petitioner accordingly and directing Respondents for payment of arrears of subsistence aliowance and other arrears accordingly.

IV. That this Hon'ble Court also further be pleased to direct the respondents to pay the all consequential benefits and award compensation with 12% simple interest to the petitioner for unnecessary harassment caused to the petitioner."

After some arguments, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to approach the respondent-authorities for redressal of his

The writ petition stands dismissed as not pressed.
