Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offences punishable under Sections 30(a) and 32(3) of the Bihar Prohibition Excise Act, 2018.

Learned counsel for the petitioner submits that the petitioner has antecedent of six cases and allegation is of recovery of 168.840 litres of liquor from three different vehicles.

Learned counsel for the petitioner submits that the petitioner was not arrested from the spot as such nothing was recovered from his conscious possession and is not the owner of any of the seized vehicles and he came to be implicated as the
Patna High Court CR. MISC. No.78057 of 2024(3) dt.18-01-2025 2/2 informant alleges that the accused persons were fleeing after seeing the police by taking their names in which one of the accused took the name of the petitioner. Learned counsel next submits that since petitioner has antecedents of five cases under the Excise Act, as such, he has been implicated in the instant case in a mechanical manner and he is in custody since 8-102024. 5.
Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the submission made by learned counsel for the petitioner, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Begusarai Excise Case No. 255 of 2024.
