The said appeal has been preferred by the appellant against the Judgment of acquittal dated 18.07.2019 passed in Sessions Trial Case No.577 of 2006 by the Presiding Officer,

Patna High Court CR. APP (DB) No.1333 of 2019(4) dt.05-03-2020 2/2 Fast Track Court-I, Nalanda at Bihar Sharif.

Since the respondent no.3 is the State of Bihar and there is nothing on the record to show that the State of Bihar has also preferred appeal against the impugned Judgment of acquittal, in our view, it is needless to permit to continue this appeal and, accordingly, this appeal stands dismissed against the respondent no.3 also.

In the result, this appeal stands dismissed.
