The petitioners are apprehending their arrest in a case registered under Sections 302, 201 and 120B of the Indian Penal Code.

The prosecution case, in short, is that while the husband of the informant to the house of accused persons, he was assaulted by them and became traceless and later on, his dead body was found. It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioner has falsely been implicated in the present case. In course of investigation, in paragraphs 31, 32 and 33 of the case diary, it has

Subsequently, post-mortem was conducted in Nepal. A U.D. case was also instituted by the cousin brother of the deceased in which no allegation was made in respect to the petitioner and other accused persons. Other co-accused persons were granted anticipatory bail vide order dated 01.11.2018 passed in Cr. Misc. Nos. 56748 and 61209 of 2018.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R./complaint case.

Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Pupri at Sitamarhi in connection with Bajpatti P.S.
