The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 341, 323, 353/34 of the Indian Penal Code.
As per FIR, when the employee namely Sri Tarkesh Kr. Mandal, Dhiren Kr. Ray and Ranjit Kr. Patel who are R.S.F. of electricity Deptt. Had gone Tappu Tola of Pipra village for collecting revenue of dues electric Bill and reached at the house of the petitioner for collecting dues amount of Rs.28,683/- and asked him to pay due amount, the petitioner refused to pay the bill amount. The employees any how saved themselves and fled away from there. Due to such assault employee Ranjit Kr. Mandal and informant were treated in Sub-Divisional Hospital, Forbesganj and as such the petitioner made obstruction in doing official work of revenue collection.
Learned counsel for the petitioner submits that the petitioner has falsely implicated in this case. There is no specific allegation of overact against the petitioner. The petitioner has got no criminal antecedent. The petitioner had deposited 60% of the due amount on 10.10.2019 a total amount of Rs. 17400/-with permission of the authority and rest will be deposited after rectification in bill.
In the aforesaid facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs. 20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in
Patna High Court CR. MISC. No. 85376 of 2019(3) dt.17-02-2020 3/3 connection with Jogbani P.S. Case No. 245 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
