====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-12-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in a case registered for the offence punishable under Section 103(1) of the B.N.S., 2023 and Section 27 of the Arms Act.

3. As per the prosecution case, the informant alleged that on 17.04.2025, one Sukhdev Thakur was killed by a bullet shot. On reaching the place of occurrence, the informant saw him dead with a bullet injury, and people informed him that some unknown person had come and killed him.

4. Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. The name of the petitioner surfaced during investigation in the confessional statement of co-accused Rocky Kumar, who stated that it was a case of

Patna High Court CR. MISC. No.73346 of 2025(3) dt.01-12-2025 2/2 accidental firing while cleaning the gun, the shot fired which hit the deceased. The petitioner had no intention to kill the deceased. The petitioner is in custody since 23.07.2025, the charge-sheet has been submitted, and he claims clean antecedents.

5. Learned A.P.P. for the State vehemently opposed the prayer for grant of bail.

6. Considering the nature of the accusation and the period of custody, the prayer for grant of bail to the petitioner is allowed.

7. Accordingly, let the above-named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bihar Sharif, Nalanda, in connection with Rajgir P.S. Case No. 200 of 2025.
