2. The petitioners seek anticipatory bail in connection with Rajepur P.S. Case No. 173 of 2023 registered for the offence under Sections 304B, 302, 201/34 of the Indian Penal Code.

3. After some argument, learned counsel for the petitioners seeks permission and is permitted to withdraw this application on behalf of petitioner nos. 2 and 3.

4. So far as petitioner no. 1 is concerned, he is the Dewar of the deceased and there is general and omnibus

5. In view of the above, this application is dismissed as withdrawn with regard to petitioner nos. 2 and 3 namely Sharda Devi and Surendra Paswan. They are directed to surrender and pray for regular bail.

6. So far as petitioner no. 1 namely Subodh Paswan is concerned, his prayer of grant of anticipatory bail is allowed.

7. Let the petitioner no. 1 (Subodh Paswan), in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like mount each to the satisfaction of learned Judicial Magistrate, 1st Class, Motihari in connection with Rajepur P.S. Case No. 173 of 2023, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
