The petitioner seeks bail in connection with Sessions Trial No.498 of 2019, arising out of Vidyapattinagar P.S. Case No.34 of 2019, registered under Sections 304B/34 of the Indian Penal Code.

The accusation is of killing the deceased, the daughter of the informant, by her husband (petitioner) and other in-laws for non-fulfillment of the dowry demand of motorcycle and gold chain.

Learned counsel appearing on behalf of the petitioner submits that, admittedly, the petitioner is the husband of the deceased, the daughter of the informant, who committed

No.66817 of 2019(3) dt.17-02-2020 2/2 suicide within one year of her marriage due to mental feverness by hanging and she was under treatment, but with an ulterior motive, the informant has lodged the present case. Further submission is that, in fact, the deceased, after locking the door, committed suicide by hanging and, thereafter, the door was broken and the dead body of the deceased was brought outside of the door and information in this regard was also given to the informant and the police. In the post-mortem examination, the cause of death of the deceased has been shown as asphyxia due to hanging. The petitioner is in custody since 16.05.2019. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.

10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge, Dalsingsarai, District-Samastipur, in connection with Sessions Trial No.498 of 2019, arising out of Vidyapattinagar P.S. Case No.34 of 2019. (Rajendra Kumar Mishra, J) P.S.
