JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-12-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in a case registered for the offences punishable under Sections 420, 308/34 of the Indian Penal Code and 23(a) 41(i) of B. Excise Act. The name of petitioner came in confessional statement of co-accused who were caught with illicit liquor. However, the informant claims that when he as well as other police officials raided a sugarcane field on the basis of discloser made by the apprehended co-accused, huge quantity of Indian made foreign liquor was recovered whereas petitioner and one co-accused managed to escape from there.

Submission on behalf of the petitioner is that

Patna High Court Cr.Misc. No.64550 of 2018(3) dt.12-12-2018 2/2 admittedly nothing was recovered from conscious possession of the petitioner and except one case petitioner does not have any criminal antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II cum Special Judge Custom, Gopalganj in Baikunthpur P.S. Case No. 141 of 2018 subject to condition as laid down under Section 438(2) of the Cr.P.C. N.K/- (Hemant Kumar Srivastava, J) U T
