JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-11-2019 Petitioners seek bail in anticipation of their arrest in connection with Kurtha P.S. Case No. 53 of 2019 registered for the offences punishable under Section 420 of the Indian Penal Code, and Rules 26-A, 27, 4, 40 of Bihar Minor Mineral Concession Rules, 1972.

As per FIR petitioners were running brick kiln without proper licence.

Submission of learned counsel for the petitioners is that they have valid licence but challan was not available at that time and later on they have produced the challan and they have no criminal antecedent and they are ready to abide by any condition that may be imposed on them.

In view of above facts and circumstances, let petitioners, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Arwal, in connection with Kurtha P.S. Case No. 53 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
