2. Show cause from the Superintendent of Police, Sitamarhi has been received.

3. This is the 3rd attempt on behalf of the petitioner for regular bail in connection with Sessions Trial No. 556 of 2022 arising out of Suppi P.S. Case No. 07 of 2022 registered for the offences punishable under Section 395 of the IPC, Section 27 of the Arms Act and Section 3⁄4 of the Explosive Substance Act.

4. Earlier the bail application of the petitioner was rejected twice by this Court vide Cr. Misc. No. 24233 of 2023 on 19.05.2023 and vide Cr. Misc. No. 83842 of 2023 on 23.02.2024.

5. The order dated 23.02.2024 passed in Cr. Misc. No. 83842 of 2023 reads as follows:-

2. This is the second attempt of the petitioner for grant of bail. Earlier his application was rejected vide order dated 19.05.2023 passed in Cr. Misc. No.

24233 of 2023.

3. The petitioner and other accused persons have committed dacoity.

The petitioner has similar and serious antecedents.

4. It has been vehemently argued by Mr. Ashok Kuman Jha, learned counsel for the petitioner that similarly situated co-accused have been granted bail therefore, the petitioner may also be granted bail.

5. This argument of Mr. Jha does not find favour with this Court.

6. In view of the similar antecedents of the petitioner,this application is againt dismissed.

7. The trial Court is directed to expedite the trial.

6. The trial has started and one witness has been examined. Mr. Jharkhandi Upadhyay, learned APP appearing for the State on instruction from Superintendent of Police, Sitamarhi has assured this Court that all the witnesses will be examined on the dates fixed in the trial and the trial shall not be delayed.

7. In view of the aforesaid facts, this application for regular bail is dismissed.
