This application for grant of regular bail arises out of Kusheshwar Asthan P.S. Case No.207 of 2022 registered for the offence punishable under Sections 302, 120-B of the Indian Penal Code and under section 27 of the Arms Act. 3.

One Indal Yadav was killed by unknown criminals. During investigation, the police has recovered the pistol used in the crime on the confessional statement of coaccused Mithilesh Yadav. 4.

It has come during investigation that deceased was having dispute with present petitioner and others and because of which the petitioner conspired with Mithilesh

Patna High Court CR. MISC. No.76780 of 2023(4) dt.10-04-2024 2/2 Yadav and other co-accused and they have killed the deceased. The petitioner is the person who had got the deceased killed after conspiring with other co-accused. The petitioner is in custody since 16.05.2023. In this case, charge-sheet has already been submitted.

Considering the aforesaid facts, I am not inclined to grant the petitioners privilege of regular bail. Accordingly, this bail application is dismissed. The trial court is directed to expedite the trial and conclude the same as early as possible.
