JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-09-2020 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. The opposite party no. 2 has also made her appearance by executing power in favour of her counsel but today, no one is present on her behalf. Perusal of order dated 09.07.2020 goes to show that on that very date also, no one had appeared on behalf of opposite party no. 2.
Petitioners happen to be parents-in-law of opposite party no. 2 and they apprehend their arrest in Complaint Case No. 708 C of 2019 in which cognizance has been taken for the
Patna High Court CR. MISC. No.70763 of 2019(5) dt.16-09-2020 2/2 offence punishable under Section 498 A of the I.P.C. Order dated 27.11.2019 goes to show that petitioners were granted provisional bail by this court with an object to resolve the dispute of the parties. However, it is informed that husband of opposite party no. 2 has already been granted privilege of bail by a co-ordinate Bench of this court vide order dated 08.07.2020 passed in Cr. Misc. No. 15624 of 2020. Considering the aforesaid facts and circumstances as well as submissions of the parties, the provisional bail granted to the petitioners vide order dated 27.11.2019 stands confirmed. In the aforesaid manner, this petition stands disposed of.
