Petitioner apprehends arrest in a case registered for the offence punishable under section 304(B) and 34 of the Indian Penal Code.

As per the prosecution case, this petitioner along with other co-accused persons committed murder of the sister of the informant.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. The petitioner happens to be father-in-law of the deceased. The allegation against the petitioner is general and omnibus in nature. The specific allegation is against husband of the

Patna High Court CR. MISC. No.1744 of 2023(4) dt.08-05-2023 2/2 deceased. Petitioner lives separately having no concern with day to day life of the husband of the deceased.

Learned counsel for the State and the informant opposes the prayer for bail. It is submitted that petitioner along with other accused persons killed the deceased for dowry. The deceased died within seven years of marriage at her matrimonial house in unnatural circumstances.

Considering the nature and gravity of allegation, prayer for pre-arrest bail of the petitioner is rejected. (Prabhat Kumar Singh, J) Alok Verma/- U T
