The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 504/34 of the Indian Penal Code and Section 27 of the Arms Act.
The prosecution case as per the written report of Balmiki Mistri submitted to the Station House Officer of Omri O.P., Ghoshi Police Station is to the effect that on 15.07.2018 at
Patna High Court Cr.Misc. No.68012 of 2018(3) dt.17-12-2018 2/3 2.00 P.M., three accused persons started abusing the informant when the informant confined himself in the outhouse of Arjun Singh. On alarm being raised, two firings were made and other persons surrounded the informant in the outhouse, who are petitioners and when the Chowkidar came the accused persons escaped from the scene.
It is submitted by learned counsel for the petitioners that there is no specific accusation against the petitioners and no accusation of assault has been levelled against any of the petitioners. It is further submitted that for a petty dispute, the accusation has been levelled against the petitioners. A statement has been made in paragraph 3 of the petition that the petitioners are not having any criminal antecedent.
Learned APP submits that the petitioners are named in the FIR.
Considering the nature of accusation coupled statement made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like
Patna High Court Cr.Misc. No.68012 of 2018(3) dt.17-12-2018 3/3 amount each to the satisfaction of learned Sub-Judge-I, Jehanabad in connection with Ghoshi P.S. Case No. 261 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
