The petitioner is in custody since 01.04.2019 in connection with Bikramganj P.S. Case No. 572 of 2018 registered for the offence punishable under Sections 302/120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that though there had been indiscriminate firing, the narration in the FIR which is of the eye-witness-informant (brother of the deceased) who has seen the occurrence specifically assigns the role of firing on the petitioner who is said to have fired while running away and also from the front.
