2. Petitioners seek regular bail in connection with Garhara P. S. Case No. 37 of 2025 in a case registered for the offences punishable under Sections 103(1) and 61(2) read with Section 3(5) of the Bharatiya Nyaya Sanhita.
3. As per the prosecution case, on 10.05.2025 at about 9:00 P.M., all the FIR named accused persons including the petitioners were having scuffle with Rana Kumar (son of the informant). In the next morning, i.e., on 11.05.2025, when Rohit Kumar (grandson of the informant) went to the roof of the
Patna High Court CR. MISC. No.74734 of 2025(2) dt.13-11-2025 2/3 library, he found that Rohit Kumar had been murdered by slitting his throat, thereafter, a suspicion was raised by the Informant that all the named accused persons including the petitioners had conspired to kill his son.
4. Learned counsel for the petitioners submits that petitioners are innocent and have falsely been implicated in the present case. It is further submitted that the informant is not an eye witness of the said occurrence and raised suspicion merely on the basis of previous enmity. It is next submitted that the specific allegation of killing the deceased is against Chintu Kumar. Petitioners have clean criminal antecedent and they are in custody since 03.06.2025. Charge-sheet has already been submitted.
5. However, learned A.P.P. for the State vehemently opposed the bail application.
6. Considering the nature of accusation and period of custody, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate- 1st Class, Begusarai/concerned Court below in connection with Garhara P. S. Case No. 37 of 2025.
