JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-12-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under section 25(1-b) a, 26, 35 of the Arms Act.

The first information report goes to show that the alleged recovery of firearms and cartridges were made from the house of Bihari Rai. So far as petitioner is concerned, he as well as some others were caught by the police in the room from which the alleged recovery was made. One co-accused Krishna Rai, having more or less, similar allegation, have already been granted privilege of bail by co-ordinate Bench of this Court whereas petitioner is in jail custody since long without having any criminal antecedent.

No.72317 of 2019(2) dt.04-12-2019 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st class, Danapur, Patna in connection with Maner P.S. Case No. 201 of 2019.
